Terms of service

1. Agreement

By accessing and using lunatemplates.co and teachable.lunatemplates.co, and by using, purchasing or recommending our products, you are agreeing to follow our terms of service and policies. If you do not agree with any of these terms, you are restricted from using, accessing or purchasing from the Luna Templates website. You are also restricted from promoting products from Luna Templates. The content and materials contained on this website are protected by applicable copyright and trademark law.

2. Template Licensing

By purchasing and using a template, you agree to the following license rules:

Single Website License: This license allows for a section to be used on one website only. If needed for more than one project, the section must be purchased again for each additional project.

Unlimited Website License: This license allows one individual to use the section on multiple websites. They may not share the code with other individuals. For studios or agencies, one license should be purchased per team member that will be using the code or accessing the materials on Teachable. 

What’s Not Allowed: Some common guidelines and limitations apply: While using Luna Templates, you cannot do the following:

  1. Sell or redistribute any code, instructional videos or course content.
  2. Claim ownership of any code, design, styles or assets.
  3. Copy and offer any sections on a similar service or store.
  4. Include any Luna Templates code as part of a theme or template being distributed or sold. 
  5. Share your Teachable login details with another individual. 
  6. Modify or remove any digital marks of code giving credit to Luna Templates. This includes but is not limited to the following usages of: "This section is designed and built by Luna Templates. Find more at https://lunatemplates.co", "LT", "luna-templates" and "lunatemplates". This applies even if the original code has been modified by the user.

By using Luna Templates products you are agreeing to abide by the license issued when purchased.

 

3. Shopify Course

By purchasing the Design Freedom on Shopify Course, you agree to the following license rules:

You cannot do the following:

  1. Share your Teachable login details with another individual. 
  2. Share course links, copies or files.
  3. Sell or redistribute any course content.
  4. Claim ownership of any course content, methods, styles or assets.

For studios or agencies, one license should be purchased per team member that will be using the code or accessing the course. Failure to comply with these rules will result in immediate suspension of your account with no refund given, a blocking of all future purchases, and the possibility of legal action taken against you.

Community Engagement
Our course community and support is hosted on Discord. By using the platform you agree to our community rules (viewable on joining). If you abuse these rules, we will exclude you from the community. Luna Digital LLC reserves the right to share and distribute content from Discord interactions however they wish. 

Live video calls within the course will be recorded. Luna Digital LLC reserves the right to share and distribute the content of the recordings however they wish. 

Support 
Course support is available for 365 days from course purchase through the designated support channels. Replies will be given within 2 business days. Students can expect support that falls within the scope of their chosen Track. For example, students in the Accelerator Track will receive limited support for coding questions as their course materials do not cover this subject matter, while Expert Track students will receive coding support that falls within the level of expertise taught in the lesson content. 

Payment Plans
When opting for the split payment plan option, you are legally bound in an agreement of full payment for the course. Failure to meet a payment will be followed by a reminder. After 7 days, if no payment has been made and no attempt to resolve full payment has been made, it will be considered failure to pay the full course amount. Consequently, the user will be removed from the course and course benefits and no refund will be given. Failure to complete full payment of the course restricts the user from using any course materials, templates, code, design or techniques in their portfolio, marketing or for commercial projects. 

Access to course benefits will not be extended past 365 days of the original purchase date. Failure to complete payment of the course may result in the possibility of legal action taken against you.

4. Business Tools

By purchasing and using Luna Templates Business Tools (such as the Shopify Store Launch Kit), you agree to the following rules:

You cannot do the following:

  1. Share your Teachable login details with another individual.
  2. Share product material links, copies or PDFs.
  3. Sell or redistribute any course content.
  4. Claim ownership of any course content, methods, styles or assets.

Failure to comply with these rules will result in immediate suspension of your account with no refund given, a blocking of all future purchases, and the possibility of legal action taken against you.

5. Free Products 

By entering your personal details on our free product pages, and confirming your email, you agree to receiving marketing and other emails from Luna Templates, from which you may change your preferences or unsubscribe from at any time. Furthermore, you agree to all terms that apply to paid templates, as stated within this policy. 

6. Access to Product

By using the Luna Templates checkout you agree to have your information shared with Teachable Inc. in order to access the product materials.

Only the purchaser whose name is on the customer account may log in to the Luna Templates school on Teachable. Passwords are a technological protection measure and cannot be shared with any other individual. Giving access to the product materials to another person will result in the deletion of the student account with no refund. 

Creating multiple accounts using a different email in order to take advantage of promotional discounts is prohibited and will result in a banning of future purchases by that individual. 

7. Termination of Access

We reserve the right to restrict or revoke access to any current or previously purchased digital products without notice if:

  1. You violate any of the terms outlined in this agreement.
  2. You initiate a chargeback or dispute regarding a payment for any of our products.

By purchasing our digital products, you agree to this policy. Refunds are not provided for any purchases, including cases where access is revoked under this clause.

8. Disclaimer

The materials on the Luna Templates Teachable website are provided 'as is'. The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

The materials appearing on the School’s website may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.

It is recommended that you have knowledge of the Shopify platform, CSS, HTML and Javascript before adding a Luna Template to a website. By using Luna Templates products, you acknowledge and agree that you are coding at your own risk. Luna Templates and other contributors take no responsibility for any damages or issues caused to any website through use of our sections. By using Luna Templates products, you acknowledge and agree that the sections may not work perfectly on every Shopify theme, and that we cannot guarantee that apps will not interfere with the sections. By using Luna Templates, you acknowledge and agree that the sections may not work perfectly on every screen size. Sections have been tested on desktop screens up to 16" and multiple mobile screen sizes. Larger or irregular screen sizes may require additional CSS to display correctly. Product support is not available for these compatibility issues. 

9. Installation Service

To receive your installation service, you must provide your email, the Shopify store URL address, the store collaborator 4-digit request code, the exact name of the theme you would like it installed on as it appears in your store, and instructions of where the section should be installed on the page. This must be provided within 30 days of purchase, otherwise the installation request will expire and no refund will be given. Once all required information is provided, sections will be installed within 2 business days after store collaborator permissions are given. We will never ask for your personal login details to install a section.

10. Support

Product support for templates is available within the first 30 days after purchase. During the support period, we can help with:

  1. Issues with the original section design.
  2. Access to your Teachable account.

We cannot help with:

  1. Installation or configuration for themes not sold in the Shopify Theme Store.
  2. Issues or outages on the Shopify platform itself.
  3. Custom code to modify a Luna Template or your store.
  4. Incompatibility issues between apps and the sections.

11. Refund Policy

Due to the digital nature of our products, purchases cannot be refunded or exchanged for any reason. Any refund requests related to user error (such as not fully reading a product's description or not confirming the compatibility of your Shopify theme), conflicting third-party codes, or simply not wanting the product anymore do not warrant a refund.

12. Affiliate Program

By joining and participating in the Luna Templates affiliate program, you agree to the terms on the Affiliate Program page and your partner dashboard. If in doubt of the terms, please email hello@lunatemplates.co before using your affiliate link. Commission fees are subject to change at any time and notification will be given by email 14 days in advance. Affiliates are restricted from using their own coupon code, or the coupon code of any other affiliate. If coupon abuse is found, these purchases will be invalidated and therefore a commission will not be paid for these orders. Luna Templates reserves the right to remove any individual from the affiliate program at any time, for any reason.

13. Modifications to Products and Services

Features and prices of our products are subject to change without notice. We reserve the right at any time to modify or discontinue products or services without notice at any time. The code for templates may be altered for the purpose of improvements at any time. We are not responsible for keeping copies of previous versions for customer use.

14. Legal

These terms and conditions are governed by and construed in accordance with the laws of Wyoming and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

You agree to indemnify, defend and hold harmless Luna Themes and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
